On May 13, 2006, the man was admitted to Memorial Hermann Hospital in Sugar Land, unable to speak and having difficulty controlling his arms and legs. The emergency room attendant had him undergo a CT scan of his brain. Almost nine months later, on February 2, 2007, he underwent a second CT scan under the direction of his doctor. Both the doctor and the MRI services company failed to detect a schwannoma brain tumor.

On June 14, the Fort Bend man underwent a third CT scan. After this scan, it was discovered that he had a schwannoma tumor. According to documents filed with the court, by the time the tumor was diagnosed, it had grown almost three times in size, from 5 millimeters in the 2007 scan to 1.4 centimeters.

The medical malpractice case against the doctor and MRI service was filed in Harris County District Court on July 20.
